Who we are

VP7 PTY LTD (ABN 95 604 106 265), of 50 St George’s Terrace, Suite 53, Perth WA, Australia, operates the VP7 ecommerce retention platform at vp7.com. We are bound by the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where we handle the personal data of individuals in the EU/EEA or UK, we also comply with the EU/UK GDPR. As a merchant you are our customer; the end-customer data you bring into VP7 remains yours — you are the data controller and VP7 acts only as your processor.

Information we collect

From you as a merchant: your name, email, company name, billing details and platform usage. As your processor, through your store integrations we hold your customers’ names, emails, phone numbers, order history, loyalty points and shipment data. We collect only what is reasonably necessary to provide the service.

How we use information

To provide and support the platform, process payments, secure accounts, meet legal obligations and improve the product. We do not sell personal information, and we never use your customers’ data to train AI models, serve advertising, or contact your customers for our own purposes.

Disclosure & recipients

We share data only with sub-processors who help us run the service, under contract and only for their specific function: our payment provider Eway (eWAY Payments) for billing, Twilio for SMS/WhatsApp delivery, and TrackingMore for carrier lookups, plus our hosting provider. We do not disclose personal information for unrelated purposes.

Overseas disclosure (APP 8)

Our primary infrastructure is in Australia. Some sub-processors are located overseas (for example, in the United States). Where we transfer personal data overseas we take reasonable steps to ensure it is handled consistently with the APPs, and EU/UK transfers are protected by Standard Contractual Clauses.

Cookies

app.vp7.com uses a single session cookie to keep you signed in. vp7.com uses no advertising or third-party tracking cookies.

Data retention

Account data is retained for the life of your subscription plus 90 days after cancellation, after which it is deleted or de-identified unless we are required by law to retain it.

Access, correction & your rights

Under APPs 12–13 you may request access to, and correction of, your personal information. EU/UK individuals additionally have rights to access, rectification, erasure, restriction, portability and objection under the GDPR. You can manage most data from Settings in the dashboard, or email [email protected] — we respond within 30 days.

Security & data breaches

We take reasonable steps to protect personal information from misuse, loss and unauthorised access (APP 11), including encryption in transit. If an eligible data breach occurs we will notify affected individuals and the Office of the Australian Information Commissioner under the Notifiable Data Breaches scheme, and EU/UK supervisory authorities within 72 hours where the GDPR applies.

The agreement

These Terms form an agreement between you and VP7 PTY LTD (ABN 95 604 106 265) of 50 St George’s Terrace, Suite 53, Perth WA, Australia (“VP7”, “we”). By creating an account or using the service you accept these Terms. If you accept on behalf of a company you confirm you are authorised to bind it.

What VP7 provides

VP7 is a B2B software-as-a-service retention platform for ecommerce merchants: email, SMS and WhatsApp campaigns, loyalty programs, automation flows, shipment tracking and store integrations. Features may be added, changed or removed with reasonable notice.

Service delivery

VP7 is delivered electronically as a hosted online service. There are no physical goods. Access is provided once your account is set up and activated, and remains available for the duration of your paid subscription.

Your account

You are responsible for activity under your account and for keeping your credentials secure. Notify us at [email protected] if you suspect unauthorised access.

Acceptable use

You may use VP7 only to contact people who have lawfully opted in to receive communications from your brand, and you must comply with the Spam Act 2003 (Cth), the Australian Consumer Law, CAN-SPAM and the GDPR where applicable. Unsolicited bulk messaging, illegal products, phishing and impersonation are prohibited and may result in suspension.

Fees, billing & currency

Subscriptions are charged in Australian Dollars (AUD). Prices shown to you in EUR or USD are indicative conversions provided for convenience only; the amount actually charged is in AUD and your bank’s conversion may differ. Subscriptions renew automatically each billing period until cancelled. Payments are processed securely by our payment provider, Eway; VP7 does not store your full card details.

Cancellation & refunds

You may cancel at any time from your dashboard or by emailing [email protected]; cancellation takes effect at the end of the current billing period and stops future charges. To cancel or dispute a specific transaction, contact us at [email protected] before the next renewal. Fees already paid for the current period are generally non-refundable except where a refund is required by law.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where a statutory guarantee applies and our service fails to meet it, you may be entitled to a remedy (including, for a major failure, a refund or cancellation) as provided by that law.

Your data

You retain ownership of all data you put into VP7. We claim no rights over it. On cancellation you may export your data, and we will delete it within 90 days unless required by law to retain it.

Liability & governing law

Subject to the Australian Consumer Law and other non-excludable rights, and to the maximum extent permitted by law, VP7 is not liable for indirect or consequential loss, and our total liability is limited to the fees you paid in the three months before the claim. These Terms are governed by the laws of Western Australia, Australia.

GDPR

How VP7 handles EU/UK personal data — read with our Privacy Policy

Controller vs processor

You (the merchant) are the data controller for your customers’ data. VP7 PTY LTD is the data processor and processes that data only on your documented instructions through the platform, never for our own purposes.

Legal basis

You are responsible for ensuring you have a valid legal basis to import your customers’ data into VP7 — typically consent (opt-in) or legitimate interest for transactional messages. VP7 supports consent-based segmentation so messages reach only opted-in contacts.

Data Processing Agreement

Merchants who need a formal DPA under GDPR Article 28 can request one at [email protected]. It covers sub-processors, transfer mechanisms, security and breach notification.

Sub-processors

VP7 uses Eway (payment processing), Twilio Inc. (SMS/WhatsApp, USA — Standard Contractual Clauses in place) and TrackingMore (carrier lookup, limited to tracking numbers and carrier codes). A current list is available on request.

Data subject rights

You can fulfil most EU/UK data subject requests (access, rectification, erasure, portability, restriction, objection) directly from your dashboard — delete via Contacts, bulk export via Settings. For assistance email [email protected].

International transfers

Our primary infrastructure is in Australia. Transfers to sub-processors outside the EEA/UK are protected by Standard Contractual Clauses approved by the European Commission (and the UK equivalent).

Breach notification

In the event of a personal data breach we notify affected controllers without undue delay and within 72 hours as required by GDPR Article 33, including the nature of the breach, the data affected and mitigation steps.

Relationship to Australian law

As an Australian company, VP7 also complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Where both regimes apply we apply the higher standard. See our Privacy Policy for full details.
